TERMS OF SERVICE

These Terms of Service, referred to as the “Terms,” govern access to and use of teralven.co and any purchase from Teralven.
In these Terms, “Teralven,” “we,” “us,” and “our” refer to the operator of the Teralven online store. “You” and “your” refer to a visitor, customer, or other user of the website.
The store is hosted by Shopify, which provides the ecommerce platform used to offer products and services.
By accessing the website, placing an order, or using a store service, you agree to these Terms and to the policies incorporated into them.
Do not use the website or place an order if you do not agree.
1. ELIGIBILITY AND LAWFUL USE
You must be at least the age of majority in your jurisdiction, or have the consent and supervision required by law, to place an order.
You may use the website only for lawful personal or business purposes.
You must not:
• Use the website or a product for an unlawful purpose
• Provide false, misleading, or fraudulent information
• Interfere with the security or operation of the website
• Introduce malicious code
• Scrape, copy, or exploit store content in violation of applicable law or Teralven's rights
• Attempt unauthorized access to accounts, systems, or data
• Use the website to infringe another person's rights
2. PRODUCT INFORMATION
Teralven aims to describe products accurately.
Product appearance can vary because of screen settings, lighting, manufacturing tolerances, materials, packaging updates, and other factors that do not materially change the product.
Dimensions, weights, colors, compatibility statements, included components, and performance descriptions are approximate unless expressly stated otherwise.
Review all product information, warnings, specifications, compatibility requirements, and restrictions before ordering.
Teralven may correct an error, update a description, or withdraw a product at any time.
A correction will not remove a customer's rights regarding an order already accepted when applicable law provides otherwise.
3. PRICES AND AVAILABILITY
Prices are displayed in the currency shown at checkout. Taxes and shipping charges, when applicable, are displayed before the order is submitted.
Product availability is not guaranteed until an order is accepted.
Teralven may limit quantities, refuse or cancel an order, or discontinue a product when reasonably necessary, including because of supplier failure, inventory error, shipping restrictions, suspected fraud, misuse, or an obvious listing or pricing error.
When Teralven cancels an unshipped paid order, the amount collected for the cancelled item will be refunded.
4. ORDERS AND PAYMENT
Submitting an order is an offer to purchase.
An automated order confirmation acknowledges receipt but does not necessarily mean the order has been accepted for fulfillment.
You agree to provide current, complete, and accurate billing, payment, and delivery information.
You authorize the applicable payment provider to charge the amount shown at checkout.
Teralven may request additional information to verify an order, prevent fraud, comply with law, or resolve a payment issue.
Failure to provide reasonably requested information may result in cancellation.
5. SHIPPING, DELIVERY, RETURNS, AND REFUNDS
The Shipping Policy and Return and Refund Policy form part of these Terms.
Product-specific conditions disclosed before purchase also apply.
Risk of loss and legal title transfer as provided by applicable law and the applicable delivery terms.
Nothing in these Terms removes a non-waivable consumer right.
6. PERSONALIZATION AND CUSTOMER-PROVIDED CONTENT
For a personalized or customized product, you are responsible for checking all text, names, dates, measurements, images, and other information before submitting the order.
You confirm that you have the right to provide any content submitted for personalization and that the content does not infringe another person's intellectual-property, privacy, publicity, or other rights.
Teralven may reject content that is unlawful, infringing, abusive, or technically unsuitable.
7. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may have separate eligibility conditions, dates, product restrictions, and usage limits.
Unless stated otherwise, promotions cannot be combined, transferred, redeemed for cash, or applied retroactively.
Teralven may cancel or correct a promotion affected by fraud, abuse, technical error, or an obvious mistake, subject to applicable law.
8. THIRD-PARTY SERVICES AND LINKS
The website may use or link to services operated by Shopify, payment processors, carriers, fulfillment providers, analytics providers, advertising platforms, or other third parties.
Teralven does not control an independent third party's website or service and is not responsible for its content, availability, or separate privacy practices.
Use of a third-party service may be governed by that party's terms and policies.
9. INTELLECTUAL PROPERTY
The website and its content, including branding, text, graphics, layout, photographs, videos, and software, are owned by or licensed to Teralven and are protected by applicable intellectual-property laws.
No right or license is granted except the limited right to access and use the website for its intended lawful purpose.
You must not reproduce, distribute, modify, sell, or commercially exploit protected content without permission or another lawful basis.
10. REVIEWS, FEEDBACK, AND SUBMISSIONS
When you voluntarily submit a review, photograph, suggestion, or other content, you confirm that it is accurate, lawful, and does not violate another person's rights.
You grant Teralven a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submitted content for operating, improving, and promoting the business, subject to applicable privacy law and any separate agreement.
Teralven may remove content that is unlawful, deceptive, abusive, irrelevant, or rights-infringing.
Teralven will not suppress a genuine negative review merely because it is unfavorable.
11. PRIVACY
Teralven's Privacy Policy explains how personal information is collected, used, disclosed, and retained.
By using the website, you acknowledge that information will be handled as described in that policy and as required to operate the store.
12. SERVICE AVAILABILITY
Teralven does not guarantee that the website will always be uninterrupted, timely, secure, or error-free.
Maintenance, provider outages, network problems, security events, and other circumstances can affect availability.
Teralven may modify, suspend, or discontinue part of the website when reasonably necessary.
13. DISCLAIMERS
To the maximum extent permitted by law, the website and its general informational content are provided on an “as available” basis.
Teralven does not provide a warranty beyond an express product warranty stated before purchase or a warranty that cannot lawfully be excluded.
Product information is not medical, legal, financial, or other professional advice.
Follow product instructions and warnings and seek qualified advice where appropriate.
14. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
To the maximum extent permitted by law, Teralven will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or a product, including lost profits, lost data, or loss of opportunity.
To the maximum extent permitted by law, Teralven's aggregate liability arising from an order will not exceed the amount paid for the product giving rise to the claim.
This limitation does not apply where prohibited by law or to liability that cannot be limited.
15. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Teralven against third-party claims, losses, and reasonable costs arising from your unlawful use of the website, violation of these Terms, or infringement of another person's rights.
This provision does not apply to the extent a claim results from Teralven's own unlawful conduct.
16. SEVERABILITY
If a provision of these Terms is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
17. NO WAIVER
A failure to enforce a provision is not a waiver of the right to enforce it later.
18. ENTIRE AGREEMENT
These Terms, the Privacy Policy, the Shipping Policy, the Return and Refund Policy, product-specific disclosures, and any additional terms accepted at checkout form the agreement governing the applicable transaction.
19. GOVERNING LAW
These Terms are governed by the laws of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law rules.
This choice does not deprive a consumer of mandatory protections or remedies available under the law that applies to that consumer.
20. CHANGES TO THESE TERMS
Teralven may update these Terms to reflect operational, legal, security, or service changes.
The revised version becomes effective when posted, unless applicable law requires another form of notice.
The Terms in effect when an order was placed continue to govern that transaction to the extent required by law.
